7. Appropriate discipline/penalty. Was the sentence reasonably related to the seriousness of the offence and the record of the past? The degree of discipline must be related to the severity of the injury. For example, an employee generally cannot be fired due to an isolated delay. The mitigating circumstances must be taken into account, as well as the employee`s balance sheet to date. The concept of «progressive discipline» is recognized as an integral part of the just cause. This means that the employer imposes increasingly severe penalties for repeated violations (such as – verbal warning, written warning, suspension, dismissal). However, some serious offences may require more discipline from the outset. Many collective agreements have a provision that requires «only reasons» before a unionized worker can be dismissed. In a union context, the term «just cause» may have a very different meaning than that used in a non-union employment contract. Within five days of the vote, the Board of Directors will contact both the employer and the union to determine which workers are part of the collective agreement unit and therefore have the right to vote. Unions and employers should expect sanctions for violations of the LRA. The maximum penalties for LRA offences are $2,000 for individuals and $25,000 for organizations.

Such termination is governed by law, both in terms of the form it must take and its consequences. For the most part, dismissal only takes effect by one or more of the undersigned unions, if it only takes effect with regard to that union or trade unions; the agreement remains in force for the other parties. If the termination is due to the employer (where there is usually only one signatory), the agreement in question remains in effect until it is replaced by a new agreement or, if it has not taken place, for a period of one year. 4. Fair investigation. Was the investigation fair and objective? The employer must conduct a fair and timely investigation. It must ensure the worker`s rights to due process and union representation.
